In the case of a serial rapist they are presumably taking DNA to compare it to fluid evidence collected from the victim. In a case like that I have no problem with the DNA being taken and used for that purpose if they have a suspect who is arrested for that crime. But, if the person is not convicted the sample should be destroyed after it has been used for it's intended purpose, not put into a database.
In the US someone who is not convicted or is let go isn't guilty under the law. The term guilty means they have either pled guilty or been found guilty by a jury or judge.
