I don't know where you are from, but MOST arrests are spur of the moment, without a warrant. MANY are arrested, in the heat of a situation, that did NOTHING wrong. Admittedly, most of those arrests are for minor crimes, but it DOES happen. Consider the case of the guy in Mississippi that was arrested and incarcerated for 8 months before he was released. He was spotted coming out of a window and arrested for burglary. It was his OWN home, the cops wouldn't listen to him, and his paperwork was lost while he was "waiting" for trial. Do you think HE is one of the ones that needs his DNA taken simply because he was arrested?

A conviction is a necessary aspect of being a criminal, not just an arrest.

I don't know how to find such information, but I would bet it would be a BIG surprise to you to learn the difference between the number of arrests and the number of convictions. It's staggering, between the number of falsly accused and convicted. While I understand that some get off because of witness falibility, lost evidence and such, MANY are arrested that shouldn't be.

While I'm at it, let me say that I HATE IT when I hear a criminal "got off on a technicality" after a judge releases him for unconstitutional violations of his rights. Our Constitution is not full of TECHNICALITIES. It's IS full of RIGHTS, and those rights must not be violated.
