DOMA has holes in it already.
There are couples with identical gender markers on their birth certificates living in many states, and have been for some time. The Feds take their tax money as married couples, they have spousal status as far as joint property, insurance, all manner of things.
Granted, one of the pair may have attained the same gender marker as the other AFTER they've been married a while.....but how is that any different from instances where a person has been assigned a gender by medical personnel early in life and then goes on to marry? If, as many assert, genetics are the final word, then these instances of non-consensual reassignment--which are more abundant than people realize--would be as suspect as self-elected reassignment...although I am sure that governmental types would not see it that way.
