In the SF Chronicle this morning, the report from Kern and Butte Counties is that when same-sex marriages become legal in California in a few days, the county clerks will refuse to perform them. But since they are not allowed to discriminate against same-sex couples, they will not perform any marriages at all. Turns out the law requires them to issue marriage licenses but not to perform marriages. The excuse is that the local budget crisis makes it to expensive. This is nonsense, especially since the county clerk is allowed to charge anything he/she wants to, and the fee can be made to cover the cost or even make a profit. It turns out that in California very few people other than county clerks are empowered to perform civil marriages. But it is unlikely that a whole lot of same-sex couples will turn up in the county courthouses in Bakersfield or Chico. In any case, some ministers in the area have agreed to perform civil ceremonies without charge as long as the clerks hold out.
